General terms and conditions of business

  • 1. Reservation

Bookings can be made without any specific formality, either in writing, by phone, or through our website.

2. Booking Confirmation

By booking, you are making a binding offer to enter into a rental agreement. The contract is concluded once we confirm the reservation in writing by email, letter, or fax.

3. Apartment Availability and Guest Responsibilities

Reserved apartments are available from 4:00 PM on the day of arrival. No compensation claims can be made if the apartment is made available later due to exceptional circumstances. Check-out must be completed by 10:00 AM on the day of departure, and keys returned as agreed. The apartment must be left swept clean, with washed dishes, emptied trash, and, if applicable, a clean and emptied dishwasher. Please report and compensate any damages that occur during your stay. Arrival and departure days are counted together as one vacation day. Late check-out may incur additional charges.

4. Travel Cancellation Insurance

We strongly recommend taking out travel cancellation insurance.

5. Deposit / Final Payment

A 30% deposit of the total rental price is due within 7 days of receiving the booking confirmation. The remaining amount is due 14 days prior to arrival. If the booking is made less than 14 days before arrival, the full rental amount is due immediately. If payment is not received on time, the landlord reserves the right to rent the apartment to another party.

6. Cancellation Policy / Written Form

Cancellations are free of charge up to 30 days before arrival. For cancellations made within 30 days of arrival, 30% of the total price will be charged. Cancellations must be made in writing to: info@urlaub-nordsee-buesum.de, unless the provider agrees to a verbal cancellation. The date of receipt of the cancellation notice determines the cancellation date.

7. Transfer of Contract

Up to the start of the stay, the guest may request that a third party assume the contract. The landlord may object if the substitute does not meet the travel requirements or is legally restricted from participating. Both the original guest and substitute are jointly liable for the rental price and any additional costs incurred by the transfer.

8. Unused Services

No refunds are given for unused services due to late arrival, early departure, or other urgent reasons. Partial refunds are only possible if the apartment can be re-rented.

9. Liability and Obligations

The rental property may only be occupied by the number of people stated in the contract, including children. Over-occupancy must be approved in writing and may incur a surcharge. Guests must treat the property and furnishings with care and are fully liable for any damages. Parents are responsible for their children. Liability insurance is recommended. The landlord is not liable for loss or damage of personal items, including cars parked on the premises, which are left at the guest's own risk. Report any issues or complaints immediately upon arrival. Leave the apartment and all its equipment in good condition. Excessive cleaning costs due to poor condition on departure may be charged. Guests are expected to do everything reasonably possible to help resolve any issues and minimize potential damage. All complaints must be submitted in writing during the stay. Pets are not allowed in the apartments. The person who brings a pet, or the contract holder, is fully liable for any damage.

10. Warranty

According to legal obligations, you must report any defects immediately to us or our on-site service. If a significant defect arises for which we are responsible, you may request rectification within a reasonable timeframe. Claims under the contract must be made within one month of the end of your stay

11. Cancellation by the Landlord

We may cancel the contract after check-in due to serious breaches (e.g., intentional damage, unauthorized persons, pets) even after a warning (which may be verbal). This results in immediate termination of the contract and departure. In such cases, the full rental price is still owed, but saved expenses and re-rental income will be deducted.

12. Miscellaneous

All claims against us (except those related to unlawful acts) expire after 24 months. They must be asserted within one month of the contractual end of the stay. This applies especially to pre- and post-contractual obligations. Transfer of claims is not permitted. If any provision becomes invalid, the remaining terms stay valid, and the contract remains unaffected.

13. Tourist Tax

The tourist tax (Kurtaxe) is not included in the rental price. It must be paid in cash upon key handover, as per the municipality of Büsum’s regulations.

14. Data Protection

Your data will be handled confidentially.

15. Jurisdiction

Court of jurisdiction is Amtsgericht Marburg, for merchants, legal entities under public or private law, or persons without general jurisdiction in Germany. The exclusive legal venue for the provider is the landlord's registered office.

16. Final Provisions

The above terms and conditions apply upon conclusion of the contract. Effective date: January 2025
